TERMS &
CONDITIONS

ARTICLE 1 — PURPOSE

These Terms and Conditions govern access to and use of the ZAINEKA service, a cognitive performance system designed for professionals. Any access to the service implies unreserved acceptance of these Terms.

ARTICLE 2 — ACCESS

Access to ZAINEKA is subject to individual application review. The publisher reserves the right to accept or decline any access request without justification.

Access is strictly personal and non-transferable. Sharing access credentials is prohibited.

ARTICLE 3 — PRICING AND PAYMENT

The ZAINEKA subscription is offered at €49 per month. VAT not applicable pursuant to Article 293 B of the French General Tax Code (Code général des impôts).

Payment is made monthly by automatic debit. The subscription has no commitment period and may be cancelled at any time, effective at the end of the current billing period.

Pricing may change. Any price change will be notified to subscribers with a minimum 30-day notice.

ARTICLE 4 — CANCELLATION

Subscribers may cancel their subscription at any time from their personal account or by contacting contact@zaineka.com. Cancellation takes effect at the end of the current billing period. No partial refund will be issued.

ARTICLE 5 — CONFIDENTIALITY AND DATA

Session data is strictly confidential. It is neither shared with third parties nor used to train public AI models. The publisher commits to processing all data in compliance with GDPR.

ARTICLE 6 — TECHNICAL SUBPROCESSING AND DATA

ZAINEKA sessions are processed via the Anthropic API (Anthropic, PBC), a technical subprocessor subject to strict confidentiality obligations. Session data is never used to train artificial intelligence models.

The user is solely responsible for the information shared during ZAINEKA sessions. The service is not intended to receive information covered by professional secrecy, business confidentiality, or any professional confidentiality obligation. The publisher cannot be held liable for any consequences arising from the user sharing such information.

ARTICLE 7 — LIMITATION OF LIABILITY

ZAINEKA is a cognitive performance tool. It does not constitute a medical, psychological or therapeutic service. The publisher cannot be held liable for decisions made by users based on ZAINEKA sessions.

ARTICLE 8 — SERVICE AVAILABILITY

The publisher commits to ensuring service availability to the best of its ability. Occasional interruptions for maintenance may occur and shall not give rise to compensation.

ARTICLE 9 — USER RIGHTS (GDPR)

In accordance with the General Data Protection Regulation (GDPR), users have the following rights over their personal data: right of access, right to rectification, right to erasure (right to be forgotten), right to restriction of processing, right to data portability, and right to object.

To exercise these rights, users may contact the publisher at: contact@zaineka.com. The publisher commits to responding to any request within 30 days. In the event of an erasure request, all session data and user profile information will be permanently and irreversibly deleted.

ARTICLE 10 — PROFESSIONAL USE AND EMPLOYER DATA

ZAINEKA is a service subscribed to on a personal basis. The publisher does not collect any data relating to the user's employer and does not transmit any information to third parties, including any employer or principal.

ZAINEKA sessions are strictly private. Under no circumstances may session data be transmitted to an employer, a manager, or any third party without the user's explicit written consent.

ARTICLE 11 — GOVERNING LAW

These Terms are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of French courts.
